从法律修辞的角度看法律翻译文本功能的实现

论文摘要

修辞在各种语言中的运用都很普遍。英汉两种语言在修辞上存在许多不同特性,使得修辞翻译成为影响跨文化交际质量的主要因素。在对于法律汉语的研究中,法律修辞的运用得到越来越多法律语言学家和法律学者的关注。法律汉语的独特性以及功能主义在翻译中的广泛运用,是本文研究修辞方法如何在不同功能的法律文本中体现的出发点。本文从功能主义的角度,采用了目的论提出的翻译行为由翻译的目的决定的观点。由于功能主义和诺德的翻译功能类型学主要运用在一般翻译实践,因此本研究尝试根据法律翻译的特点对这种类型学进行适当的调整,使其能运用到法律修辞的翻译过程中,提醒法律翻译者重视法律文本的目的性,以实现译文的交际功能为目标选取翻译策略。本文首先分析由Kelson提出的法律文本的主要功能,并对规范性法律文本以及描述性法律文本进行探讨,在此基础上进一步地得出主要法律文本的下级功能。接着,本文作者在对法律修辞的要素进行分析后,深入探讨各种修辞方法在不同功能的法律文本中的具体运用以及从功能翻译的角度对各类修辞的翻译进行分析。最后,在对文本的交际功能进行识别的基础上,本研究讨论了法律翻译工作者在处理法律修辞翻译时应当采取的策略以实现目标法律文本的功能。
