法律翻译中的归化

在翻译中有两种翻译策略:归化和异化。归化是以目的语文化为中心的翻译策略,即运用目的语文化易于接受的表达法,使目的语读者更容易理解译文。异化是以源语文化为中心的翻译策略,保留语言文化差异以便更好地体现源语文化的异国情调。归化和异化是翻译界龃龉已久的话题。西方的归化肇始于古罗马,异化则由德国哲学家施莱尔马赫提出。中国归化和异化的讨论可以追溯到佛经翻译,“文质之争”可算当时翻译中归化与异化之争的最早交锋。随着国际贸易的发展,人们对法律翻译的需求也与日俱增,法律翻译的地位也越来越重要。不论翻译何种法律文本,翻译活动的关键在于翻译策略的选择。从某种程度上来说,法律翻译质量的高低也取决于翻译策略的选择。翻译策略的重要性是笔者致力于研究翻译策略的动力。本文旨在描述和分析归化,同时研究归化在法律翻译中的应用。首先,本文列出东西方关于归化和异化的不同观点,并举出支持归化的中西方学者及其理论,从而证明归化的科学性。其次,笔者把理论与实践联系起来,将归化应用到法律翻译中。笔者从词汇层面和句法层面来证明归化策略在法律翻译中的实用性。最后,本文指出在法律翻译中没有绝对的归化和异化,它们的关系是相辅相成的。
