语篇分析理论基础上的法律书面语研究

论文摘要

本论文是关于法律语篇分析问题的讨论,重点是运用语篇分析等语言学知识解析法律语篇的语言特点和篇章结构。从学科划分角度,本文研究的内容属于法律语言学范畴,是语言学的一个新兴的分支学科。文章重点从微观和宏观两个方面解析法律篇章语言的特点。从微观角度讨论了法律语言的特点。文章一开始讨论法律语言的词汇特点,具体包括法律术语、常用法律词汇、借词、陈词、行话和模糊词。然后进一步研究了法律语言的句法特点,具体有复杂长句、近义词重复、反义对词、副词从句和名词化等现象。然后从语义层讨论了法律语篇中的言语行为现象和在法律语篇中应避免言外之意。从宏观方面介绍了语篇分析在法律语片中的应用。一方面,讨论了主位/述位和主位递进在法律语片中的体现。另一方面,讨论了法律语篇中的衔接与连贯,尤其是其中的衔接词。随着我国法律制度的不断完善,对法律语言的研究必然更加深入。法律语言学作为一门边缘学科必然对语言研究的应用和法律应用做出突出的贡献。
