从文本分析的视角看司法文书翻译

论文摘要

司法文书是法律文书的重要组成部分,是公安机关、人民检察院、人民法院等司法机关和非诉讼机关、当事人极其代理人依据法定程序,在司法诉讼活动中或与诉讼有关的非诉讼活动中,依据事实,适用法律法规所制定的并使用或者提交的具有法律效力、法律意义或者法律价值的各类文书的总称。国内外传统上对法律翻译的研究,是从语言学的角度,认为法律翻译就是语言转换,主要从单一的词句等层面展开,也就是只对某些文内因素进行研究,追求译文的忠实。但在整个法律翻译过程中,译者要先后经过一系列思考决策过程,从语用方面开始到最后的词汇处理方面。因此,译者不仅要考虑影响翻译决策的一切文内因素,还应该考虑与之关联的文外因素。本文从诺德的翻译文本模式出发,对司法文书的文内和文外各因素进行了宏观层面的综合文本分析,并总结了在司法文书翻译过程当中所出现的翻译问题。同时,作者根据文本分析的结果,提出了解决这些问题的翻译原则。
