《中华人民共和国合同法》两种英译本的评析

论文摘要

交际翻译试图使其读者产生的效果尽量接近于源语读者所获得的效果。语义翻译要在译语句法结构和语义结构允许的前提下,在译文中产生相似或完全一样的语境意义。根据对文本功能的分类,纽马克认为法律文本属于表达型文本,因此法律翻译应采取语义翻译。作者认为纽马克的这一陈述主要适用于源语和目标语的语言体系和结构相似的情况。如果源语和目标语属于不同的语系,在思维方式和语言结构等方面就会有差异。比如说,英语和汉语属于不同的语系,由于英汉两种语言在思维方式,表达习惯,以及法律文化等方面的差异,单纯地进行语义翻译是行不通的。本文作者认为在法律翻译中语义翻译和交际翻译是互相补充的。在法律翻译的初始阶段译者应遵循语义翻译,尽可能在词汇,句子等方面与原文一致。而在第二阶段采用交际翻译,译者要充分考虑目标语和源语之间的种种差异,积极发挥译者的创造性,以读者的角度审视并诠释原文,用目标语对原文的内涵进行再创造,达到译文与原文在法律效力上的对等。作者认为可以将语义翻译和交际翻译有效地结合,从而更好地增强法律译本的可读性。本文从这一主题入手,试运用纽马克的这两个著名翻译理论对中华人民共和国合同法的两个英译本进行评析。
