论文摘要
村民自治是一种基层民主制度,村民自治权是这种民主的核心。村民自治权是一个多层次的概念:从国家治理的角度看,村民自治权是一种治理权;从村民自治权的本质看,它是一种民主权利;从村民自治权的主体上看,村民自治权又就是一种身份权;从国家和社会分权的角度看,村民自治权是村民的一种自治权力。村民自治权在性质上属于一种社会自治权,村民自治权来源于权利对权力的制约,它的主体是作为个体的村民,它体现着宪政的基本理念,即民主、自由和法治。村民自治权作为中国农村民主化进程的新生事物,它的实现必然会受到多种因素的阻碍和制约,本文提出了保障村民自治权实现的对策。村民自治是中国民主宪政建设的基础工程,村民自治权的实现具有重大的价值。
