汉英立法文本的句法特征及其文化阐释

论文摘要

近年来有关法律语言的特征分析、法律语言风格特征、法律语言与翻译原则等研究方面出现了一些论文或论著,但关于英汉法律语言的句法对比研究方面尚有很大研究的空间。为此,本文试图通过分析英汉立法语言的语体和句法特征,从传统文化的角度论述了产生这些句法差异的原因,以期对法律语言的深入研究奠定一定基础。论文除引言和结语外,共由四章组成。第一章简要分析了立法语言的主要特征。作者结合法律的特征,即规范性、权威性和抽象性,分析了相应的立法语言特征,即精确性、晦涩性和机械性。第二章主要介绍汉英立法文本的句法特征。文章从句法的定义及其研究对象出发,探讨了汉英立法文本在综合语与分析语、形合与意合、语序、句子信息结构安排、主语突显与话题突显及主动语态与被动语态等六个方面的句法差异。汉语以分析语为主要特征,主要靠意合手段组合句子;它以意念为主轴,话题突显,多用人称主语和主动语态。此外,汉语的词序安排主要以时、空发展及心理上的轻重为序,重隐性连贯;句子信息中心一般后置,呈句首开放、句尾封闭型分布。而英语则属于分析-综合语,主要靠形合手段组合句子。它以主谓提挈为主轴,主语突显,常用物称主语和被动语态。词序安排上重逻辑推理,前短后长,重显性衔接。句子信息中心常前置,呈首端封闭、尾端开放型。第三章总结英主要汉立法文本中的特殊句式。在长期的立法实践中,立法者逐渐形成了一些不同于民族共同语的句式表达习惯。在汉语立法文本中主要有“的”字结构、“是”字句、“对”或“对于”句、“但”书句及并列结构。在英语立法文本中主要有“otherwise"结构、“where”结构、“any person who...shall....”结构、“subject to”结构、“provided that”结构、“notwithstanding”结构、“for the purpose of”结构和“with respect to”结构等。第四章主要探讨汉英立法文本中句法特征产生的文化渊源。本章从文化的定义、分类及其与语言之间的关系入手,分别介绍了汉英地理文化、经济政治制度文化及意识形态的差异,并从这些文化渊源上介绍了汉英句法差异形成的原因。中国地域广阔而封闭,地理环境优越,在远古时期就有了发达的农业文化。早熟的农业文明使得中国在政治上始终没有冲破氏族血缘关系。高度专制的封建宗法统治形成了封建帝王“家天下”的统治模式。与这些经济、政治制度统治相适应,“天人合一”、“以人为本”及“贵和尚中”的思想一直在中国意识形态领域中占主导地位。反映在句法结构里,表现为汉语具有分析语、重意合、话题突显、多用主动语态及固定的语序等句法特征。英国是一个封闭而又开放的岛国,与欧洲大陆有着千丝万缕的政治、经济及血缘关系。其先民流动的生活方式,独立而又分工协作的封建庄园经济,使得他们能够冲破氏族血缘关系,政治关系复杂,长期处于不统一的状态,基督教文化占据主导地位。“主客二分”、“以神为本”及“理性对抗”是其意识形态的主流。在句法结构中表现为英语具有分析—综合语、重形合、主语突显、多物称主语和被动语态等句法特征。语序则按照形式逻辑推理的模式进行安排。
