法律术语的文化因素及其翻译策略

术语是现代科学的精髓,法律术语是法学的重要组成部分,法律术语的翻译在法律文化交流中的作用不言而喻。法律翻译最重要的问题在于译者如何解读不同法律体系下的法律术语在异域语言中的传达、创制,直到准确无误地将异域法律文化的法律术语转化为目的语法律文化读者所能接受的同等表达——即译文术语。文化交流及趋同已成为当今社会的潮流。翻译作为文化交流的主要方式,在两种不同文化及语言之间架起了一座桥梁,文化因素的作用引起了越来越多翻译者的注意。众所周知,若从文化的角度来看翻译,文化因素是翻译过程中的主要障碍,文化内涵丰富的法律翻译也不能例外。由此,本文尝试讨论及解决文化因素给法律术语翻译所带来的困难。本文主要由两部分构成。第一部分对文化因素在法律术语翻译中的体现进行了系统、详尽的分析,并提出所涉及的文化因素主要包括社会制度、法律体系、法制功能、法律制度及程序、法律文化传统、文化心理和思维方式的差异,从而揭示了法律翻译时译者所面临的问题。第二部分旨在提出解决法律翻译过程中的文化因素差异应遵循的原则和策略。
