论《中华人民共和国合同法》的翻译

论文摘要

我国合同法是1999年3月15日经第九届全国人民代表大会第二次会议通过。1999年3月15日中华人民共和国主席令第15号公布。自1999年10月1日起施行。该合同法,对推动国民经济发展,扩大对外经济、贸易、科技、文化交往,保证社会主义现代化建设顺利进行具有重大意义。对于进一步保证进出口企业的合法权益、规范企业经营管理、促进企业发展也将起到十分积极的作用。随着中国改革开放的深入和加入世界贸易组织,越来越多的法律文献已经被或正被翻译成英语。因而,法律文献的翻译显得更为重要。相对于法律文献英译汉,汉译英是一个较薄弱的环节,尚未形成一个系统的体系。本文作者通过对合同法英译本评析,结合英美现行与合同有关的法律,探讨法律文献英译的特点,希望能够为我国法律文献的英译尽一份力。全文共分四章：第一章简要介绍中西方翻译理论的发展和展望。第二章作者介绍了法律英语的特点和翻译,指出汉译英应该特别忠实于原文的内容,遵循法律英语的文体特点,并且应该符合译入语的语法规范。第三章介绍了《中华人民共和国合同法》的一般背景和主要内容并列结合功能对等法列出它的三项功能。第四章指出了译本在翻译方面的一些不妥,包括结合对比英美合同法,反映法律英语特色的词法、句法、文体方面的不妥,以及译文不符合译入语规范的方面,并提出了自己的改进方法。硕士研究生：刘雪丹指导老师：毛浚纯　副教授
